The same directory describes the beach as steps away, with restaurants, Pier 60 and the marina nearby. For the town itself, see our Clearwater Beach guide.

Rules buyers ask about
Rentals
The building directory and recent listing records show a one month minimum, and the association site says minimum 30-day rentals are allowed. The association site also says rental agreements are arranged between the owner and the renter, and that guests and renters must register before arrival. The City of Clearwater does not allow rentals under 31 days or one calendar month on residentially zoned property, according to its Citizens Guide to Code Compliance. Confirm the zoning, the association minimum and any limit on leases per year. See our short-term rental rules guide.
Pets
The building directory and three recent listing records show no pets. Get the current rule, and any exceptions, in writing from the association.
Parking
County legal descriptions for many units include the use of a numbered under-building parking space, and listing records show one assigned, covered space. Some unit legal descriptions name no space. Confirm which space conveys with the unit you are considering.
Building condition and condo law
440 West was built in 1975, and at 17 stories it falls under the milestone inspection requirement in section 553.899, Florida Statutes. For a building that reached 30 years before July 1, 2022, the statute required the first milestone inspection before December 31, 2024, then every 10 years. The structural integrity reserve study requirement in section 718.112 also applies to each tower. Request:
- The milestone inspection summary for each tower, and whether a phase two inspection or repairs followed
- The most recent structural integrity reserve study and reserve funding schedule
- The current budget and annual financial statement
- Twelve to 24 months of board minutes
- Any adopted or proposed special assessments, including any for hurricane repairs
- The master insurance policy declarations, including wind and flood deductibles
Hurricane Helene’s storm surge flooded homes and businesses on Clearwater Beach in September 2024, as WFLA reported. The association’s site, when we checked in October 2026, said “our property is under major construction due to Hurricane Helene.” We did not find news reports about 440 West specifically. A 2026 listing says all current special assessments have been paid in full, another 2026 listing mentions building updates and modernization, and an undated listing describes millions of dollars of common area upgrades over five years. Ask what was damaged, what work is complete, what remains, how it is being paid for and whether any insurance claims remain open. Our condo inspections, reserves and SIRS guide explains what to look for, and our condo buyer checklist lists the documents to request.
Flood and insurance
Recent listings for units in both towers show flood zone AE. Check the parcel on the city’s flood zones and elevations page, which also shows elevation certificates and a property’s substantial improvement and substantial damage history where available, and get your own HO-6 and flood quotes early. See our flood zones and insurance guide.
