Intracoastal frontage

The 50% rule and what it means for a Mitchell’s Beach home
The City of Madeira Beach applies the rule through its own building department. Its Substantial Damage Quick Guide states the test: if the cost to repair is 50% or more of the structure market value, the structure is substantially damaged and must be brought up to current floodplain standards, which can mean elevating or replacing it. After the 2024 storms the city posted substantial damage determination letters by address.
In 2025 the Legislature passed SB 180, now section 163.31795, Florida Statutes, which bars local governments in the National Flood Insurance Program from adopting or enforcing any cumulative substantial improvement period.
